THE MINISTER IN EXERCISE OF THE POWERS CONFERRED ON HIM PURSUANT TO SECTION _______ OF THE  ENVIRONMENTAL PROTECTION AND MANAGEMENT ACT HEREBY MAKES THE FOLLOWING REGULATIONS;-

 

PART I

PRELIMINARY

Citation

1. These Regulations may be cited as the

ENVIRONENTAL PROTECTION AND MANAGEMENT (EFFLUENT LIMITATIONS) REGULATIONS, 2013.

Interpretation

2. In these Regulations, unless the context otherwise requires:

Act” means the Environmental Protection and Management Act;

“Department” means the Environment Department established under section 7 of the Act;

effluent” means sewage or industrial effluent;

industrial effluent” means liquid water or waste water produced by reasons of the process taking place at any industrial or commercial premises;

inland waters” includes any reservoir, pond, lake, river, stream, canal, drain, spring or well, any part of the sea abutting on the foreshore, and any other body of natural or artificial surface or subsurface water;

licence” means a licence granted to a person under regulation 5, 6 and 7;

“licensed premises” means premises occupied by a person who is the holder of a licence issued in respect of the premises under these Regulations;

“parameter” means any of the factors shown in the first column of the First Schedule or of the Second Schedule and any other factors which may be Prescribed.

“sewage” means any liquid waste or waste water discharge containing human, animal or vegetable matter in suspension or solution, and may include liquids containing chemicals in solution;

“sewer” means any line of pipes or channel with their appurtenances designed and used to convey effluent;

sewerage system” means a system incorporating sewers and all other structures, devices, equipment, and appurtenances intended for the collection, transportation, and pumping of effluent including a treatment plant;

treatment plant” means any facility for the conditioning of effluent to effect reduction or partial reduction of its potential to cause pollution;

Application

3. These Regulations shall apply to discharges of effluent into any inland waters or the marine environment in Antigua and Barbuda, other than the effluents discharged from premises specified in the Third Schedule.

 

PART II

LICENCE TO DISCHARGE EFFLUENTS

Prohibitions

4. (1) No person shall:

(a) discharge on or cause or permit the entry into waters, on the ground or into the ground, of any effluent or any poisonous, noxious or polluting matter; or

                  (b) construct, reconstruct or alter any works for the discharge of                     any effluent or any poisonous, noxious or polluting matter,

except in accordance with a license for the purpose granted by the Authority under these Regulations.

(2) Any person who contravenes the provisions of paragraph (1) shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding one hundred thousand dollars or to imprisonment for a term not exceeding three months or to both such fine and imprisonment.

 

Application for a license to operate a treatment plant

5.(1) Subject to paragraph (2) a person who intends to operate a treatment plant for the discharge of effluent or sewage shall apply to the Authority for a license to do so.

(2) A license shall not be required if-

(a)     the discharge of effluent or sewage results from domestic waste effected-

(i) by means of absorption or soak-away pits; or

ii) other prescribed waste disposal systems; and

(b)     is in accordance with such provisions as may be prescribed by or under these Regulations or any other law in force pertaining to such disposal.

(3) Every application to discharge effluents shall be in the form as prescribed under the fifth schedule.

(4) The license shall be valid for a period of twelve months from the date of issue.

 (5) An application made pursuant to this regulation, shall be accompanied by

                  (a)     the application fee prescribed;

(b) where applicable, a compliance plan for approval by the   Authority;

(c)      an environmental impact assessment; and

(d) any other document requested by the Authority for the purpose of evaluating the application.

(6) The Authority may issue a license pursuant to an application before approving a compliance plan, but the date of such approval shall not affect the date of issue of such license.

(7) A compliance plan submitted with an application made under paragraph (5) shall form part of the terms and conditions of the license.

(8) The Authority may request the following information to be included in a compliance plan-

                  (a)     details on how the treatment plan will be operated;

(b)     a description of the current compliance status of the  treatment plant including-

                                    (i)      all effluent sources;

                                    (ii)     the discharge points; and

                                    (iii)    the monitoring locations;

                  (c)      a list of the pollutants that exceed effluent standards;

                  (d)     a statement of methods used to determine the treatment plant’s compliance status, including-

                                    (i)      a description of all monitoring, record keeping;

                                    (ii)     reporting and test methods; and

(iii)    any other information necessary to verify    compliance with or to enforce applicable requirements;

(e)     a statement that the treatment plant shall continue to comply with each applicable requirement in respect of which compliance is currently achieved at the treatment plant; and

(f)      in respect of each applicable requirement for which compliance is not currently achieved at the treatment plant-

(i)      a detailed statement of how the treatment plant will achieve compliance; and

(ii)     a proposed compliance schedule which sets out the remedial measures to be taken, including a sequence of actions with milestones leading to compliance.

(9) The Authority shall review the proposed compliance plan and shall in writing notify the owner or operator of the treatment plan as to whether the plan has been approved or refused or if further information is required.

(10) Where the compliance plan is refused, the notification of such refusal shall-

                  (a)     set out reasons for such refusal; and

                  (b)     inform the owner or operator that he is entitled to revise and resubmit the compliance plan within sixty days of the date of delivery of such notification.

Application for a license to construct a sewage wastewater treatment facility

6. (1) A person who intends to construct a sewage wastewater treatment plant, shall apply to the Authority for a licence to do so.

(2) An application made pursuant to paragraph (1) shall be-

                  (a)     in the form as prescribed by the Authority;

(b)     accompanied by a plan in respect of the management and operation of the plant; and

(c)      accompanied by the application fee prescribed;

(d)     accompanied by any other document requested by the Authority for the purpose of evaluating the application.

(3) The Authority may issue a license to construct a sewage wastewater treatment plant if the requirements under paragraph (2) are adhered to.

(4) A person who constructs a treatment plant except in accordance with a license issued under this regulation commits an offence.

Application for license for discharge of effluent or sewage effluent into the environment

7. (1) A person whose business, industry, manufacturing or trade operations involve the discharge of effluents, or both, as the case may be, from a treatment plant into the environment, shall apply to the Authority for a license to discharge such effluent into the environment.

(2)  An application made pursuant to paragraph (1) shall be in the form as prescribed by the Authority.

(3) No application shall be processed prior to the payment of the full amount of the prescribed application fee.

(4) Where the Authority issues a license under this regulation the discharge of effluent, sewage or both, shall be in accordance with the terms and conditions of the license granted by the Authority.

(5) A person referred to in paragraph (1) whose operations discharge effluent, sewage or both into the environment except in accordance with a license issued under this regulation commits an offence.

Display of licence

8. The holder of a license shall display his license in a conspicuous position in the principal building of the premises.

 

PART III

RENEWAL, MODIFICATION, SUSPENSION AND REVOCATION OF LICENCE

Fee for license including renewal of license

9. (1) A person who intends to renew a license issued under these Regulations shall make an application in the form as prescribed by the Authority and pay the renewal fee prescribed.

(2) Where the Authority receives an application for renewal of a license after the license has expired, the application shall be dealt with as if it is a new application.

(3) An application for renewal shall not be processed where the discharge fee for the previous calendar year has not been paid.

Modification of licenses

10. (1) The Authority may modify a license where-

(a)     ownership of the enterprise, construction or development in respect of which the license was granted has changed;

(b)     the licensee proposes to change the process of operation or the technology used and this is likely to cause a change in the nature or composition of the discharge of sewage and trade effluent and wastewater;

(c)      the Authority establishes new or revised standards in respect of the undertaking of any enterprise, construction or development; or

(d)     any other reason exists which, in the opinion of the Authority is relevant in determining whether a license is to be modified.

(2) The licensee shall pay to the Authority a modification fee as prescribed.

Authority may suspend or revoke a license

11. (1) Subject to regulation 12, the Authority may, by notice to the licensee, suspend or revoke a license, if-

(a)     the licensee fails to submit monitoring reports in accordance with regulation _____;

(b)     the licensee submitted false, misleading or inaccurate information or omitted relevant information in the application for the grant or renewal of a license;

(c)      the licensee falsifies or gives misleading information in a monitoring report;

(d)     there is an attempt at or falsification of any record of environmental monitoring;

(e)     the licensee commits a breach of any term or condition, implied or expressed, in the license;

(f)      the licensee fails to pay fees due and payable to the Authority in respect of the license;

(g)      the level of pollution from any discharge from a treatment plant has or is likely to have, an adverse effect on public health or the environment; or

(h)     the licensee fails to submit a compliance plan or other documents requested by the Authority for the purposes of these Regulations within the time specified.

Notice to suspend or revoke a license

12. (1) The Authority shall, before revoking or suspending a license, serve on the licensee of the treatment plant concerned a notice-

(a)     specifying the breach, and where the breach is capable of remedy, requiring the licensee to remedy within the time specified in the notice; and

(b)     informing the licensee that he may apply to the Authority to be heard on the matter within the time specified in the notice.

(2) A licensee who applies pursuant to paragraph (1) (b) to be heard on the matter of the suspension or the revocation of the license shall be heard by the Authority within one month after the receipt of the notice.

(3) An appeal against a decision of the Authority to suspend or revoke a license shall be made to the Minister.

PART IV

INFORMATION, ALTERATIONS ETC.

Notice to supply information

13. (1) The Authority may by notice in writing require the owner or operator of any sewage treatment plant, industrial waste treatment facility or any facility for the disposal of solid waste or any other facility for controlling pollution, to submit to the Authority at such intervals as may be specified in the notice, information relating to all or any of the following:

                  (a) the performance of the facility;

                  (b) the quality of the effluent discharged;

                  (c) the area affected by the discharge of effluents;

                  (d) the steps being taken to abate or control pollution;

and such owner or operator as aforesaid shall comply with the requirements of the notice.

(2) Any person who refuses or fails to comply with the requirements of a notice under sub-regulation (1) shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding fifty thousand dollars or to imprisonment for a term not exceeding three years or to both such fine and imprisonment.

 

Furnishing information in certain cases

14. Where due to accident or any unforeseen event in any industry, any poisonous, noxious or polluting matter is discharged or likely to be discharged into any inland waters the owner or operator of any such industry shall promptly notify the Authority of any such occurrence.

Reporting changes in information furnished for purposes of application

15. An applicant for a license or for the renewal or transfer of a license shall, within seven days of the occurrence of any material change in any information furnished in his application, give the Authority a report in writing of the change.

Continuance of existing conditions and restrictions in case of change of occupancy

16. Where a person becomes the occupier of licensed premises in succession to another person who holds an unexpired license in respect of the premises, then the conditions and restrictions of the license shall be binding on the new occupier and shall be observed by him, notwithstanding that he is not yet the holder of the license.

Making changes that alter quality of effluent

17. (1) The holder of a license shall not make, or cause or permit to be made, any material change to the premises or in the matter of running, using, maintaining or operating the premises or in any operation or process carried on at the premises, which change causes, or is intended or is likely to cause, a material increase in the quantity or quality of effluent or both discharged from the premises, unless prior written approval of the Authority has been obtained for the change.

(2) For the purposes of paragraph (1), material changes to licensed premises include:

(a)     any change in the construction, structure, or arrangement of the premises or any building serving the premises;  

(b)     any change in the construction, structure, arrangement, alignment, direction, or condition of any sewer or sewerage system;

(c)      any change of, to, or in any plant, machine, or equipment used or installed at the premises; and

                  (d)     any changes in the use of raw materials.

(3) An application to carry out any work, building, erection or alteration shall be submitted to the Authority in the prescribed form and shall be accompanied by the fee prescribed.

(4) The Authority may grant such application either subject to conditions or unconditionally and may require the applicant:

                  (a) to repair, alter, replace or install control equipment;

(b) to conduct a monitoring programme at his own expense or bear    the cost of such programme within such period or at such time and in  such manner as the Authority may specify.

 

PART V

EFFLUENT, SEWAGE SLUDGE AND INDUSTRIAL SLUDGE

Prohibition of discharge of effluent containing certain substances

18. No person shall discharge or cause or permit the discharge of any of the following substances into any inland waters or into the marine environment:

(a) any inflammable liquid;

(b) any tar or other related liquids;

Standard methods of analysis of effluents

19. For the purposes of these Regulations, the effluent discharged into any inland waters shall be analyzed in accordance with the latest edition of the methods specified in the Fourth Schedule, as amended from time to time, or in accordance with such other methods of analysis as may be prescribed.

 

Point of discharge

20. (1) The point or points of discharge of effluent shall be approved by the Authority.

(2) The position and design of the outlet at the point or points of discharge of effluent into any inland waters or onto any land as determined in sub-regulation (1) shall not be altered or changed without the prior written approval of the Authority.

(3) Wherever the concentration of any parameter of effluent discharged or to be discharged is mentioned in these Regulations, the reference, unless the context otherwise requires, is to the concentration as at the point of discharge approved in paragraph (1).

Installation of anti-pollution equipment

21. (1) The Minister may by order require that every industry shall install anti-pollution equipment for the detoxification of effluent and chemical discharges emanating from the industry.

 

(2) An installation made pursuant to paragraph (1) of this Regulation shall be based on the Best Practical Technology.

Parameter

22. No person shall cause or permit any effluent to be discharged from any industry specified in the First or the Second Schedule in respect of which he or she is the owner or operator in quantities or concentration higher than those specified in the said Schedules.

Treatment of effluent

23. (1) Every industry which discharges effluent shall ensure that such effluent can be assimilated by the receiving water into which the effluent is discharged.

(2) The Authority shall be furnished from time to time with the composition of any effluent treated as specified in paragraph (1) of this Regulation.

Restrictions on the disposal of sludge

24. No person shall discharge or cause or permit the discharge of any solid waste or sludge that is generated from any production or manufacturing processes or from any effluent treatment plant in or on any soil or surface of any land without the prior written permission of the Authority.

Industrial sludge shall be harmless and suitable for disposal

25. A person responsible for the treatment of industrial sludge shall ensure that the sludge is rendered harmless and suitable for disposal in a landfill, in accordance with the standards prescribed by the Authority.

Prohibition of unauthorized persons, livestock and other animals

26. A licensee who operates a treatment plant shall prevent unauthorized persons, livestock and other animals from having access to storage and treatment ponds for sewage sludge or Industrial sludge that are part of the plant, in order to protect health and well being.

Discharge of sewage sludge or industrial sludge

27. A person commits an offence if he-

(a) disposes of sewage or industrial sludge without the written approval of the Authority; or

(b) discharges of sewage sludge or industrial sludge that does not meet the relevant standards as prescribed by the Authority.

Monitoring, sampling and analysis

28. A licensee who operates a treatment plant that produces sewage sludge or industrial sludge or both shall, before the sludge leaves the plant, monitor, take samples, analyze the sludge produced and keep records on the operation and performance of the treatment process and the final product quality.

Testing of sludge for use in agriculture

29.  A producer of a sewage sludge shall ensure that the sludge produced and supplied for use in agriculture is tested-

                  (a) not less than every six months; or

(b) whenever any change in the characteristic of the treated sludge occur as a result of-

                           (i) changes in the treatment process; or

                           (ii) the wastewater being treated.

Operation and maintenance of sewerage systems

30. (1) All sewers and sewerage systems shall be maintained in a good working order and sanitary manner to the satisfaction of the Authority.

(2) The owner of any sewerage system shall keep daily, weekly, and additional records in such forms as may be specified by the Authority, of the operation and maintenance of the sewage purification plant and all such records shall be open for inspection by the officers of the Authority.

 

PART VI

INSPECTIONS AND WARNING NOTICE

Provisions for inspection

31. A person who discharges effluent into any inland waters, the marine environment or onto any land shall, in connection with such discharge, install such sampling test point or points inspection chambers, flow meters, and recording and other apparatus as may, from time to time, be prescribed.

Occupier to render assistance during inspections

32. An occupier of any premises shall provide any other officer duly authorized in writing by the Authority every reasonable assistance or facility available at the premises that he may require for the purpose of taking action that he is empowered by the Act or these Regulations to take in respect of the premises.

Authority shall issue warning notice

33. (1) The Authority may issue a warning notice to any person who breaches these Regulations or fails to comply with the terms and conditions of any license issued to that person.

(2) The warning notice shall state-

                  (a)     the nature of the breach;

(b)     the outcome required or remedial action to be taken by the licensee;

(c)      a reasonable period within which the remedial action shall be carried out and notified to the Authority by the person; and

(d)     that the person may apply to the Authority to be heard in relation to the breach within such time as may be specified in the notice.

(3) Where a warning notice is served on any person referred to in paragraph (1) a copy of the notice shall be posted in a conspicuous pace on the premises where the breach is taking or has taken place.

 

PART VII

TRANSITIONAL PROVISIONS

License for construction and operation of treatment plans

34. (1) Where a person at the commencement date-

(a)     holds a license for the construction or operation of a treatment plant which construction or operation is scheduled to commence within one year after the commencement date; and

(b)     intends to carry out scheduled construction or operation, the person shall apply for a license pursuant to regulation 5 or 6, as the case may require.

(2) A person who, on the commencement date, is the holder of a license to discharge trade effluent or sewage effluent issued under the Act-

(a)     may  subject to sub-paragraph (b), continue to operate the treatment plant to which that license relates, until the date of expiration of the license; and

(b)     shall not less than six months before the expiration of that license or twelve months after the commencement date, whichever is shorter, apply for a license under regulation 5(1).

 

Unlicensed effluent discharges

35. (1) Within twelve months of the commencement date, every owner or operator of an existing treatment plant shall, apply for a license to-

                  (a)     operate the treatment plant; and

                  (b)     discharge effluent.

(2) Where later than one year after the commencement date, an owner or operator of an existing treatment plant discharges effluent without a license as required under these Regulations, the owner or operator commits an offence under the Act.

 

PART VIII

PENALTIES

Offences and penalties

36. (1)Any person who contravenes the provisions of these Regulations for which no specific penalty is prescribed, shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding fifty thousand dollars or to imprisonment for a term of imprisonment not exceeding two years or both such fine and imprisonment.

(2) No prosecution for an offence under these Regulations shall be instituted except with the leave of the Authority or of the Director of Public Prosecutions.
