Laws and Enforcement

The Draft Environmental Protection and Management Act has been a long project in the making.  The Act, once approved by Parliament, will creates new responsibilities for the Ministry of Health & Environment. Most notably these powers will include the power to delegate inspectors who have the powers of entry, inspection, the issue of prohibition notices and the power to compel and execute certain works (specifically those that are in the interest of the preservation of the environment). There are new offences and their corresponding legal consequences created. The offences are related to discharges that are harmful to the environment, the hunting, killing or export of specific (protected) animals and mass deforestation.   This Act streamlines the mechanisms to implement environment related policies regarding pollution, natural resources (watersheds, wetlands, protected areas and flora and fauna) and biodiversity. Within the act there is established the SIRFF (Sustainable Island Resource Framework Fund) which provides financing for projects that focus on the sustainability and conservation of natural resources. On an international level the legislation creates a board which is responsible for the coordination, management and implementation of any Multilateral Environmental Agreements (MEA’s) to which Antigua and Barbuda are signatory and also provides opportunities for the country to benefit monetarily from any samples that are indigenous that may be used in biological studies and further developed into products.
